This is a question we receive quite often.
Example: You qualify for a 2 bedroom and have 3 people living in the house with you. Your uncle needs a place to stay. You have an extra bed or maybe space in the den/living room.
– Is that a problem?
– Can he stay with you?
– Or will that put your Section 8 Voucher at risk?
Here are the facts:
What you need to know about Section 8 Rules for Visitors
Section 8 Rules are very strict! It is important that you realize this right away, before you start getting yourself into trouble. Breaking the rules may mean that you will loose your voucher forever.
The only people allowed to officially live in your home have to be reported on your HUD 50058 form. This is a form that is included in the application process (and the annual renewal) for Section 8 benefits. It’s called the “Family Report” and outlines each member of your family that will be living with you. This is how Section 8 determines the amount of bedrooms you qualify for.
Even a blood relative, who is NOT officially a part of your household, is considered a guest. This can be a parent, sibling, child, grandchild, etc. This means visitation rules will apply to this person, and he/she will not be able to simply live with you.
If you want someone to stay with you for a substantial period of time, you need to receive approval from your PHA.
How Long Can a Visitor Legally Stay In My Home?
According to Section 8 rules, a visitor CANNOT stay in your house for MORE than 14 consecutive nights without approval.
Some of you may be thinking “Great, I’ll just have him/her stay out of my place once every 2 weeks and it will be all good.” WRONG!! The 2nd part of the rule states that a person CANNOT stay with you more than 21 nights total in any one year (12 month period, not calendar year).
Also, keep in mind that the burden of proof is on you, the voucher holder, not the other way around. So if you are reported (by your landlord, friend, etc.) or are accused by your PHA of having an unauthorized individual living with you, it is your responsibility to prove otherwise.
Finally, you should know that it is possible to formally petition your HA and your landlord to extend the 14 night visitation period. You must have a strong reason for this request and explain it clearly in your letter. Also, it is best to submit this letter as soon as possible; don’t want for the 14 night period to pass! If HA approves your request, be sure to keep their letter for your records.
Proving that a “Visitor” is NOT living with you
It is important to know that if you are allowing an authorized visitor to stay with you longer than allowed by Section 8 rules, you are committing FRAUD. This is because in your annual household application, which is a LEGAL document, you sign that the number of people staying with you is true and correct.
However, there may be a scenario, that you have been wrongfully accused, and that person really is a guest.
In any case, once your landlord or Housing Authority suspects that someone has been living with you without authorization, you will need to prove that they actually reside somewhere else.
Here is a list of documents you may need to present. (note, this is a general list, and a particular Housing Authority may need some additional information):
- Mail to the visitor’s “real” address
- Current utility bill from the visitor’s real address
- A lease with a visitor’s name on it
- A signed/notarized statement from the persons you are residing with and a signed/notarized statement from the allegedly-unauthorized individual as well.
What happens if it is discovered that an authorized individual has been living with you?
Depending on state and federal laws in your location, a few things may happen:
- The Housing Authority will take away your Section 8 voucher for good. This means that you will not be able to reapply for Section 8 for a set period of time, or ever in this state.
- If Housing Authority discovers that the person living with you has income, they will request documentation and raise your rent accordingly, to capture the subsidy they have overpaid.
- If you request to include this person in your household, and they are approved, your rent will also go up (if they have official income).
Overall, it is very important to find out what the rules are where you live, before you allow someone to stay with you.
Why are Section 8 Rules So Strict?
You may be wondering what the big deal is if someone starts to live with you? What is the harm?
There are two reasons why the rules are so strict:
Housing Authorities try their best to protect residents and landlords, and to maintain drug and crime free housing. This is why, every member of your family has gone through a criminal background check, before HA approved them for Section 8. An unauthorized visitor has not gone through this criminal background check, so he/she may turn out to be a felon, sex offender, drug addict, etc. A HA would not consider this person safe and would not want them on premises.
HA calculates the reduced amount of rent you pay, based on the reported number of people in your household and your reported income. If someone is staying with you and helping you out with rent, this means you are actually stealing money from the government. This is because if this person would be officially included in your household, your rent would be higher!
Why would anybody report someone having people not on there lease staying with them instead of minding their own business cause when you do so you are jeopardizing their housing and livelihood and there could be reason why they can’t be on their lease from past mistakes noone is perfect but you jeopardize their housing and become the reason that they become homeless and it is hard out here.i would never have that on my conscious that a family is homeless because of me minding their business.that is for housing to find out,that’s their job to do not yours.i wouldn’t tell on my worse enemy and see them homeless cause my mother raised me better than that and you have to have an evil spirit to do some utterly hateful stuff like that and don’t care about anyone besides yourself.their kids etc.its not hard to mind your own business in this world.thats why it’s so much crime and murders in this world from people minding other people’s business and once a person losses everything they get to the point where they don’t care anymore and have nothing to lose.

What if the person staying isn’t contributing to the rent and already owns their own home in another state? For example, they come stay with you for three months during the summer. They don’t sell their home, they don’t do a change-of-address, they’re just spending the summer and not helping pay the rent.

You are getting free rent if you are getting any money from the government so why complain? You can ask for an appeal but why not just follow what the housing authority tells you to do. Show some gratitude.

Live-in guests are a common thing in Section-8 housing and similarly subsidized properties. Some residents have had guests for over two years. HUD is not that interested in knowing. They can’t follow up on all claims and ‘proving’ a guest has overstayed their welcome is near impossible. Can’t prove a guest wasn’t just visiting for a few hours and not overnight. And to all those calling freeloaders ‘assh*les’ – you’re exactly right. Even if he resident is desperate and needs companionship, the guest is still an assh*le for jeopardizing anyone’s housing. HUD and its approved Housing programs should do better. Wake up Ben Carson!
We have a Felon living in the ‘Tahoe senior plaza’ housing, apt 107 for over 5 months now management has been told many times still nothing done many of us residents are afraid, he has been seen climbing in his mothers apt window at night trying to sneaking in ,Like you said nothing will be done till someone gets killed or raped!

I agree. I lived with my daughter for 2 yrs. When she could not pay her half of the bills i paid them all. I am 60yrs. My daughters are all in their 40s. My youngest and oldest got into a altercation. I tried to intervene and eventually they stopped. I left for the planned stay with my youngest daughter. A fes days later her and i were served with a protection order. I have been unable to get my belongings and in the processes of looking for a apartment. I dont understand this. My life for 2 yrs gone. The animals i took care of daily i can’t see. I am lost and confused looking for a place to go is a challenge. Why would my daughter do this to me

I just received my voucher and my worker said that I can have a significant other live with me but I don’t think I’m letting anyone live not to visit me. I have little ones and people are truly crabby when they feel like if they don’t have it then others shouldn’t and that is not cool.

How can you evict a person thats not on the lease that won’t leave after you ask them too and they refuse.
Give them a 30 day notice to vacate if they don’t leave you must follow up with eviction but that might get you evicted as well if you are submitting.
Get a restraining order on them. It’s the only fast way. Other wise you will have to give them 3 months and you know what people may do in that time out of anger.

If you’re not on her lease you’re not suppose to be living there. She can only have guest a consecutive 14 days, unless she goes to section 8 and puts you on her lease. Nonconsecutive visits are 21 days in one year. Hope this helps, best of luck.

First of all, if you decide to leave the section 8 with some one else, unless there name is on section 8 then u will lose ur side of section 8. Then they would give it to other house hold member, only if they start a back ground check on both of the family member, and have income too pay rent to section 8. If I’m on sec 8 and I want to add a relative child to my housing voucher. What type of paperwork do I have to provide? Can the child be I foster child and I refuse foster care payments. Would that let them be added. Because it states that a foster child cannot be added to voucher because you are getting payed by the fostercare system. Well I dont want the money. I’ll figure it out. I am on Section 8 and in 2012 they changed it from single parent to disabled (I receive supplemental security income/ ssi). I made a mistake and let my (fault) friend stay 1 night so he could get a good night sleep and be ready for another friend that owned a small business could pick him up for work (within a few days had to fire him). Now, my so-called friend refuses to leave and he knows that I am on Section 8 and don’t cares if I become homeless since I no longer have family near by. How can my landlord and I get if out without getting into trouble? He had threaten both by saying that we allowed him to move in since I am disabled to care for me. What you have is a non-problem! You need to beat your friend to the punch. Call the police to put him out, which they problem wont because of it being a civil situation, but this will put your effort on record. Next, call section 8 and explain it to them, so that they can assist with getting him out. Have your landlord to back up your efforts. You can also have the locks changed. You will also want to contact section 8 and explain the problem to them and let them put him out. However, the longer you wait to do anything the worse it will become for you, because it will only look like you have invited him to stay.

I work over nights and live on hud housing out in Oregon. my boyfriend is listed as my care provider since he is the one providing care for my children while i work. Recently i recieved a unauthorized guest sitation for him being at my home more then he is supposed to. We provided a hand written lease agreement from his step mom (whom he lives with currently) my a landlord is not excepting that as a formal lease agreement. I have contacted hud about the situation. They have informed me that he must leave the three nights i am off. Does this mean he can not come over during the day as well? My apartment manager is demanding i put him on the lease because she sees him and says “He lives there”. Or im getting a ten day eviction notice. I have complied with his not staying at my apartment but the nights i work now it seems like im being told he cant come over during the day on the days i am off..

How do I let the authorities know that someone has been and still is abusing the system. She has had people live with her and give her money for rent. She has two people living there that is not on the paperwork for section 8. I just hate when people abuse the system when there is people out there that really need it.

Firstly people have to go through a screening process prior to getting Sec. 8. Just because they LOOK able-bodied doesn’t mean that they are. People with mental health issues also qualify. I don’t “hate” anyone and I don’t even get Sec. 8.
So I haven’t stayed with a woman who has section 8, I have been there for about 4 months, I have gotten one letter mailed to her house. Last night, she had a crack attack, she smokes heavily and has people in and out paying her to use the house. I was evicted out of section 8 apt in oct. Principe, because the household Prettygirl is aware of has unauthorized people living with them, everyone else in the complex is at risk as management is not able to properly vet these folks. Has stated that he is worried about losing his section 8, because he didn’t report his girlfriend living with him.
Now, he’s telling me he wants to get a Restraining Order against her, to have her move out of the apartment. Claims she has a Dr.Jeckle / Mr. Hied, Personality.

You can ask a person to vacate in 3, 30 or 60 days & just pray they leave! If not… the only way of getting them out is by filing an
Unlawful Detainer through the courts.
You cannot put a person out in 3 or 30 days, & changing locks are illegal as well.

Is it legal to kick someone off Section 8 without an informal hearing that was requested? Also, I have no key to my mailbox because someone changed the lock, but mail came here for about 9 different people I have never heard of before I lost the key ( because someone removed it from my purse while I was asleep) and the mailman will not return the mail to sender. Is there anyway to report the housing inspector? I have been taking care of my elderly dying mother and when the inspection was scheduled I had a friend come to my house to let them in. One of the smoke detectors in the bedrooms malfunctioned and had to be replaced within 24 hours. So I had the same person come back the following morning and wait for them so I could go and take care of my mother. The inspector was a rude jerk and accused my friend of living at the residence, which they do not. He tried to explain he was just helping out and the inspector yelled at him and told him section 8 would find out what was really going on. I am not worried since I have nothing to hide, but I find his behavior extremely unprofessional and rude and am hoping there is someone I can contact about this.

We both live in Missouri and i have been his best friend for almost 20 years, with our relationship it could be argued that i calm his rage and help him be a better person. he has a two bedroom apt and wants me to live with him but does not want to risk getting taken off sec 8. i make roughly $25000 a year, and i do not have any felonies, what all would i need to do and could i even qualify to be added to his voucher, would they even factor in that he has less outburst when im around

My nephew lives in a home with his two children and has a Section 8 voucher. The children’s mother (who is unstable and only sees the kids under the court’s supervision) called the housing authority and stated that both a girl he used to date and his mother live with him illegally. The housing authority wants him to provide proof of where they both currently live (leases and utility bills). My nephew’s mother lives in another state and they haven’t spoken since she visited him (for two days) a year ago. He and the girl broke up when she finished school and left town. Even if he knew where to contact them it’s unclear if they would actually help. What can he do? How can the housing authority compel people who don’t receive Section 8 or have anything to do with the person who does receive it to provide information to them?

Most likely not. They’ll finger print him, run a back ground check, and go from there. The whole reason they do O background checks is to keep felons, sex offenders, etc out.

Go to the section 8 / mdha office and ask to start the process of adding your daughter and grandchild to the voucher. They will give you the information to fill out. It is an easy process. The only hurdle is there rules on past felony drug charges and domestic violence charges. Even then I would still fill out the information and talk to your section 8 worker about the charges. In some cases they will still approve it. No disrespect intended with me mentioning the last part.

If the tenant abandons the home, then that tenant is considered to have moved out. If that tenant was on section 8, then, except under certain circumstances, the tenant is to have violated the terms of their lease, and the tenancy would end. If the landlord took the tenant to court and won the case, the tenant will likely have lost their voucher. Any extra information, such as family members and other people who were not authorized to stay with the tenant in the first place, would not apply and could not remedy the situation. Voucher is handy to a person, not the property (unless this is public housing, which is owned by the public and is property based). In the case where the landlord is evicting the tenant, the landlord would also be inviting anyone who is living on the property, authorized or not. The voucher is not handed down to the next tenant by that means.

If the person is staying on the property in a camper, and the person is not staying with you, The voucher holder. If the landlord consents to you parking the camper on the property, you can stay as long as you want, or as long as the landlord permits: This is just between you and the landlord, not the Housing Authority administering your friend’s voucher.

If the person you know is violating their section 8 rules, then you have the right to report it to the Housing Authority that is handling their voucher. If you do not know which Housing Authority that is, write to or call All of the Housing Authority‘s that are in that jurisdiction. My minor son has a disability and has been in and out of jail a couple of times which I was honest about to section 8. My understanding is that if you have company to your resident, you are responsible for everything they do and say to your resident. If the neighbor feels like your company is disrespecting them, they have the right to report you to HA. It’s in your lease that you signed to, to respect your neighbors. You have to remember you can be reported to PA for anything especially if the neighbors feel disrespected by your guests. They can even call the local police on you as well.

Frequent parties? Frequent gatherings? Those have nothing to do with your housing authority whatsoever. The question is: is anyone or any group of people staying at your place more than 14 nights consecutively? If your answer is no, and you’re telling the truth, and this has nothing to do with the Housing Authority and as such does not fall under their jurisdiction. If the partygoers or other visitors are not behaving themselves within your control – read your apartment lease carefully, because most apartment complexes have a rule that the tenants must have control over the visitor or visitors and their behavior.. If those kinds of rules are violated, then the landlord can evict, and you could lose your voucher. However, the landlord must give you notice to correct the problem and the opportunity to correct it before they can kick you out.

Fired for petty theft? Petit theft is a misdemeanor, and if you were fired for it, not arrested for it, then the Housing Authority cannot do anything about it in terms of kicking out the voucher holder.

I got into it with my landlord he threatened to evict me and served me a a 60 day with no reason. And did not inform HA. I took it t HA and they returned it to him and now he has mailed only a 3 day for subletting and telling me to remove any cars not registered to me. Rotten and unfair as it seems, you have to tell the Housing Authority if you have Section 8. I’ve found out the hard way. I was seeing someone and the building manager claims the person lives here because they have spent too many nights in a 12 month period (No more than 12 consecutive and 21 in a 12 month period). We’d spend one or two nights per week together, and it was so nice not to be alone. This year I’ll be seventy and believe me this is extremely traumatic. I was not aware of these rules until after I was served papers, and then began to research it. Can you imagine being put on the street at 70? Yes, you have to tell your PHA about your son and daughter. It is very likely your rent will increase, but that is better than the alternative I face. Best of luck to you.

The working family members are responsible for getting their own place, not join you with your voucher. Remember, your rent is calculated according to your ability to pay: generally 1/3 of your income minus utility allowance. If you are on section 8 how many days are you required to satay a month. It is no where on my lease about that. I did read about how you can’t have a guest for more than 14 consecutive days and not more that 21 days in a year. But nothing on someone actually living in the house hold.

When’s voucher is given, is it strictly for the person on the voucher our is it intended for spouse as well? A tenant has the voucher in her name only. And she is the only one on the lease. My ex daughter in law lives in a 2-3 bedroom section 8 apartment (by herself). One of her kids (not my biological grandson) spent a few years in juvenile detention. He lived with her afterwards until he turned 18, at which time she made him move “so she wouldn’t lose her section 8”. Meanwhile her younger son (my biological grandson) lived with me for the last 12 years. He’s now 20 and could afford to help pay her rent but she claims she would lose her sec. 8. Is it true, in Mass., that your own child cannot move in with you? Or would it just require an approval from section 8?
Any family members you want to add to your voucher must be approved by S8 before they move in. Tenant submits a form to S8 and they will approve or deny. One of my tenants added his college aged daughter to his voucher.

She moved him in with her. The man is a 40 year old convicted felon, drug addict, and overall con man. Long story short, my widowed mother took pity on the guy and they developed an intimate relationship. When she realized the man was a thief and swindler she broke it off. Everyone was upfront from the beginning with the manager of the building about his presence. She wasn’t concerned, until the guy started stalking my mom and harassing her. He walked around the building drunk, high on pills, and screaming at my mothers windows. She and several other residents are afraid now. The manager was told how the situation had changed and that my mother felt she was in clear and imminent danger. The guy was told to leave, and he did, for 2 weeks. Now he’s back and hiding at his moms. How can we get this man out FOR GOOD? (I guess it wasn’t such a short story after all, I apologize)

Anyhow, I guess the manager finally took this seriously and has given his mother an eviction notice for keeping him there. So they’ll both have to leave in “30 days”. I hope that’s what will come of it all. I hope this is just a hard late in life lesson for my mom, and she can move on a little wiser. She’s staying with my husband and I until next month.

Well, we stay in the NC, and my aunt was reported by someone that she had her boyfriend staying with her since she had joined the state program PHA. I hoped my aunt has not lied about her boyfriend staying with her because then she will have to prove everything that she told them. I know her boyfriend has lived with her for over 10 years and she never added him to her lease. Someone reported her to PHA and I believe she is being watched by PHA officers. I am praying for her because she doesn’t have proof of him living elsewhere and plus he works. She never added him to her lease nor his income. I feel she is in big trouble. My aunt is not talking to me because I do know a lot about her situation but I didn’t report her to PHA. I think one of her visitors reported her because they had gotten into a disagreement about something. I would vote for her to file for the restraining order; hasn’t she already reported the matter to the manager? If he’s no longer staying with her, he can’t affect her. She will have to request you and your son be added to the voucher and you both will have to apply to the Housing Authority. Her rent will go up accordingly. If either of you just move in without going through the process it is entirely likely she will lose the Sec-8. If you and your son move elsewhere, remember you can only spend 21 days (only 12 consecutive days) TOTAL with your girlfriend in a 12 MONTH period. Good luck.

Report to the Section 8 office. In my situation, I reported her directly to the caseworker who initially wrote her up for having an unauthorized dog in the unit. Yes, that was one of the issues but the unauthorized people spending the night were the bigger issue. Took going above to the supervisor and the program manager to get that addressed. Now still trying to get her out. Getting ready to provide security video footage of the activity.

Yes, and in America, the person is stealing – both from the government and from the landlord. I have a unit rented to someone with a 2 BR voucher for her and her disabled son for whom she gets disability, food stamps, no more – but the son doesn’t even live with her. Meanwhile, the boyfriend, a convicted felon not on the lease – and a bunch of others are living in there, running up the water bill, wear and tear on the apartment, and dealing drugs.

How do I report unauthorized occupants in section 8 housing? The actual recipient is in jail (and has been for months and will be indefinitely) and is receiving section 8 benefits while living in a cell. The people living in qualified recipients apartment are essentially living there free.
Call your county’s HUD office and tell them you’d like to report a lease violation. 🙂

My mother reported it and she was still kept on it, but recently our mother passed away and s8 made my sister HOH. Now the apt complex is telling her she can’t stay because of a no full-time college student law. Does she just lose it? If YOU are not a voucher holder, you can’t port anywhere.
If you ARE a voucher holder, then you can port to any city and state that is currently accepting ports as long as you file the correct paperwork and receive acceptance from both HA’s.

I was just turned in by my slumlord for having my boyfriend stay@ my apartment for most of the past 6 months >> 1st 4 months, until he got a new apartment, because he has lung cancer & lived over the ovens, grills, oil & grease of a pizza shop. He was peeing, barfing & pooping blood until he began staying @ my much heal Section 8 apartment. Then I got sick 2 months ago & he’s been helping me out. Right now, he has no income so his financial “benefit” 2 me is nil. I am having a difficult time comprehending where how why these rules apply in health care situations. Talk to me please, somebody. That’s nothing mines threathing to report us cause coincidentally we had a visitor visiting us the two times she came and she said she would report us to section 8 now I can’t have friends visit me cause she assumes they live with my family. Im requesting moving papers ASAP!!

How do you add someone to your section 8? If they leave your place, do they get to keep they’re section 8 and go anywhere that takes section 8?
You have to inform your local Housing Authority within 30 days. Also it will come up in your annual recertification papers

Report them! Report them all! We the people need to hold the Section 8 thugs and slumlords that ignore their lawbreaking accountable. Law-abiding homeowners are under risk from these people who think they are above the law. Put these scofflaws back in their place-anywhere away from good people who worked for what they own.
Dear M. Garcia: “thugs”? I have Section 8. Met a man w/lung cancer who lived above a pizza shop > all kinds of grease in the air > that got in2 his & my lungs = made us both sick. I took him in2 my apartment FOR HEALTH REASONS for 4 months not knowing about Section 8 visitor rules. Got reported by the downstairs neighbors. Then I GOT SICK, unable to function daily. Turn about is fair play ,> he’s been helping me but I moved temporarily in2 his apartment = Section 8 paying for an apartment in which I am currently not staying. QUESTION: do our health problems make me a “thug”? Please advise. Thank you.
